Personal Injury Claims including claims against the Road Accident Fund

Many of us have been involved in motor vehicle accidents or know of family members and friends who have been victims of road accidents. In South Africa, the government has created a compensation scheme called the Road Accident Fund (RAF) to compensate victims of road accidents on South Africa’s roads who have suffered injuries and lost income and have had their earning capacity compromised.

The victims include, drivers, passengers, cyclists and pedestrians or if a breadwinner in a family has been killed in a road accident, the family are entitled to claim for loss of support and funeral expenses from the Road Accident Fund.

A claim against the Road Accident Fund must be instituted within 3 years from the date of the accident. Therefore, the earlier you contact us the better your chances of lodging a successful claim against the Road Accident Fund.

Unlawful Arrest

Whether you have been hurt, injured or wrongfully arrested and detained by the police and as a result you have suffered damages due to the intentional or negligent actions of the police, you might be entitled to a compensation from the state.

Unlawful arrest infringes upon your constitutional rights as a citizen, therefore it amounts to a gross violation of the Constitution of the Republic of South Africa which recognises that everyone has inherent dignity, right to freedom and the right to have this dignity and freedom respected and protected.

It might be a daunting and intimidating task to institute a case against the police, but if you have been in a situation where a police officer acted in an unfair and abusive manner contact us and our attorneys will provide you with all the assistance required to successfully institute a legal claim against the police for a fair compensation for the damages you might have suffered.

Business Rescue and Restructuring

If your company or a company in which you have an interest is in financial distress or insolvent, we can advise you on the next steps to take. Business rescue is a legal framework and mechanism created to assist companies in financial distress return to solvency by restricting the company’s operations. If you need advice on this process or want to institute any of them, contact us.
